1. Introduction and Acceptance

Lead Fuel provides software—not agency services, strategic advice, or performance guarantees. Your outcomes depend solely on how you use the Platform.

Age Requirement – 18+ Only: You must be at least eighteen (18) years old (or the age of majority in your jurisdiction, if higher) to register or use the Platform.

2. Description of Service

2.1 Scope

Multichannel outreach covers email, select social channels, AI-generated outbound phone calls, AI-handled inbound phone calls, web-chat widgets, and website-visitor identification. Lead Fuel is not a marketing agency and does not offer human consulting or performance guarantees. We grant you a license to use our technology; success is determined by your own implementation and use cases.

2.2 Data Accuracy & License Restrictions

Accuracy Disclaimer: The Contact & Company Database and Visitor-Identification data are compiled from multiple public and private sources and may contain outdated, inaccurate, or incomplete information. We make no warranties regarding their accuracy or suitability for any purpose.

Internal‑Use License: You receive a non‑exclusive, non‑transferable, internal‑use‑only license. Reselling, redistributing, or sublicensing database records is prohibited.

2.3 AI‑Generated Content & Model Training

User Responsibility: AI outputs (emails, call scripts, synthetic voice calls, web-chat messages, etc.) may contain errors or non-compliant material. Users are solely responsible for reviewing the output of their AI Agents and making any necessary adjustments.

2.4 AI Voice Features

Description: AI Outbound Calling autonomously places phone calls on your behalf. AI Inbound Calling answers and handles incoming calls routed to your assigned numbers.

Call Recording & Consent: Calls may be automatically recorded and transcribed. You are solely responsible for obtaining any required one-party or two-party consent and for displaying legally compliant call-recording disclosures.

Telemarketing & Robocall Compliance: You must comply with all applicable telemarketing, auto dialer, and robocall laws, including the U.S. TCPA, TSR, and any state or foreign equivalents. You must maintain and honor internal do-not-call lists.

2.5 AI Web Engagement Suite

Description: The Suite provides embeddable AI-powered widgets and visitor-identification that attempts to match anonymous site visitors to business identities.

Cookie & Tracking Compliance: You are responsible for implementing legally required cookie banners or tracking disclosures (e.g., GDPR, ePrivacy, CCPA) and for obtaining end-user consent before activating any tracking or fingerprinting code.

Inference Limitations: Visitor identities are probabilistic and may be inaccurate. You must verify any inferred data before taking action.

3. Account Registration and User Information

You must supply accurate, complete workspace‑owner details each time the Agreement is presented during sign‑up. Workspace‑owner information cannot be changed after registration. If you provide false or incomplete information, Lead Fuel may refuse any refunds, extensions, credits, or other compensation.

You are solely responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account.

4. Subscription, Billing, and Payment

Plans: Subscriptions are available on quarterly or annual terms and are billed in USD through Stripe. All fees are non-refundable once the account is activated.

Auto‑Renewal: Subscriptions renew automatically unless cancelled under Section 4.1.

Payment Authorization: You authorize Lead Fuel (and Stripe acting on our behalf) to charge your designated payment method for all recurring fees and any usage-based overages.

4.1 Managing Your Subscription

You may cancel, upgrade, downgrade, or update payment details at any time in the secure billing portal. Cancellations must be submitted at least 48 hours before renewal to prevent the next charge. No pro‑rated refunds are issued.

4.2 Dispute Policy

Before initiating a chargeback or dispute, you must email support@leadfuel.ai and allow 14 days for investigation. Unauthorized disputes violate this Agreement, and you will reimburse related fees and costs.

5. Domains and Mailboxes

Domains or mailboxes provisioned by Lead Fuel incur third-party costs and are non-refundable once created. If you connect your own mailbox or domain, you assume all deliverability and compliance responsibilities.

6. Termination, Suspension, and Refund Policy

Either Party may cancel this Agreement if the other breaches its terms. No refunds are issued for terminations for cause or convenience. All fees are non‑refundable.

7. User Conduct and Acceptable Use

You must comply with all applicable laws (e.g., CASL, GDPR, CCPA, CAN‑SPAM, TCPA, TSR). You may not use the Service for spam, illegal marketing, or prohibited industries such as tobacco, firearms, or adult content.

8. Content, Intellectual Property, and Feedback

All Platform content—including AI‑generated content—is owned by Lead Fuel or its licensors. You may not copy, resell, or distribute it. Any feedback you provide becomes Lead Fuel’s property.

9. Limitation of Liability and Disclaimers

The Platform is provided “as is” and “as available” with no warranties. Lead Fuel’s total liability is limited to the lesser of (i) fees paid for the current subscription period or (ii) the unused portion of that period. We are not liable for indirect, consequential, or punitive damages.

10. Third‑Party Agencies Disclaimer

Any engagement with third-party marketing partners is solely between you and that partner. Lead Fuel is not liable for outcomes or disputes arising from such relationships.

11. Indemnification

You will indemnify, defend, and hold harmless Lead Fuel from any third‑party claims arising from your use of the Platform or violation of this Agreement.

12. Privacy and Data Usage

Your use of the Platform is governed by our Privacy Policy. Call recordings and visitor data are stored encrypted. You are responsible for required disclosures and user consent.

13. Dispute Resolution and Governing Law

Any dispute will be resolved by final, binding arbitration. This Agreement is governed by the laws of Delaware, USA. You waive the right to participate in class actions.

14. Changes to the Agreement

We may change the Service features or terms at any time. The latest version of this Agreement supersedes previous versions.

15. Miscellaneous

This Agreement constitutes the entire contract between you and Lead Fuel. If any provision is unenforceable, the rest remains valid. Failure to enforce a provision is not a waiver. Lead Fuel may assign this Agreement without notice.

16. User Acknowledgment

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. THE SERVICE AND ALL OUTPUT DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES—EXPRESS OR IMPLIED—including merchantability, fitness for a particular purpose, and non‑infringement.

BY USING LEAD FUEL YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT.
